NEW YORK - A federal judge Wednesday found unconstitutional a part of the United States’ anti-terror Patriot Act that allows authorities to demand customer records from businesses without court approval.

U.S. District Judge Victor Marreo ruled in favor of the American Civil Liberties Union, which challenged the power the FBI has to demand confidential financial records from companies as part of terrorism investigations.

The ruling was the latest blow to the Bush administration’s anti-terrorism policies.

I for one am totally disgusted that the Federal Government is using the blood of the Americans killed on 9/11 to take away the freedoms that so many Americans have died to protect.

Just wait till the pornettes learn that they can sue for that nasty throat infection they got from doing ass to mouth, or for the surgery need on their assholes after a double penetration, or for the chlamydia they got in the workplace. Just wait for a hungry lawyer to come in and make a practice of this type of litigation.

Mean time on a more positive note we have Red Light District offering a 100,000.00 reward for any information leading to the arrest and conviction of anyone making illegal copies of “1 Night in Paris”. With the elections coming up, a frenzy of mud-slinging between the Republicans and Democrats has begun. Debate over whether or not there should have been a war, and over the adversaries’ military records, is in full swing.

Let me state from the outset that I’m a Libertarian and do not much care for either major party in this election. I hear liberals cry about how much they want to see George Bush out of office, claiming that Kerry is the man they want to see run this country. What amazes me is that anyone even cares who is in office.

When Bush first took office, pornographers everywhere sweated over the notion that it would be the end of porn. However, rather than fading away, porn has become more abusive and demeaning than ever before. I have seen acts of so-called adult entertainment that make me afraid to turn the pages of porn magazines because what I see might put me off my dinner or scare my small dog.

It was easy to defend adults having sex on film, but I can’t defend movies that display men pissing in women’s eyes (only one of the depraved acts that people now insist on shooting). It was bad enough when we stood by and tacitly accepted porn featuring girls purposely having cum shot into in their eyes.

Anyone who has had cum in their eyes knows it stings like a motherfucker, and you’ll that have red, swollen eyes for the rest of the day. I can’t imagine how piss feels, nor do I ever want to experience it! I see previews and photos of these acts on the Internet and wonder whatever happened to good, old-fashioned fucking. When did a blowjob or reaming some chick’s asshole stop being good enough?

As in the past, the requisite few weeks of outcry have concluded following the recent industry HIV scare. With concerns over health issues and talk of the government stepping in to force condom use, you would think we’d make an effort to do fewer health-risking porn scenes. Lets face it, if you look back at the last two industry HIV incidents, you would see that the sex act had more to do with the transmission of the disease than anything else.

The first of the two events was the world’s biggest anal gangbang — a hundred guys plowing some delusional porn “star’s” asshole and cumming in her bleeding rectum. The second event involved rumors of girls working with transsexuals in Brazil, then crossing over into hetero scenes and cramming two cocks into their asses at once. Of course, fuel was added to the fire by sperm shooting into the bleeding cavity.

Given the fact that HIV is a blood-semen transmitted disease, you then have a perfect incubation environment to allow the virus to be transmitted. Why don’t we just all sit around and have an orgy with drug addicts who share needles?

I have been in porn for a few years now and have seen a lot of trends come and go, but some of the most recent behaviors are clearly breeding grounds for health issues. If you don’t want to contract HIV, then don’t engage in sex acts that are ideal for HIV transmission.

Don’t get me wrong — I think that as an industry we have done plenty to try to curb the spread of HIV. But I believe that more needs to be done, and that we have to start with something called personal responsibility. I think that the government’s getting involved in regulating our industry is ludicrous, considering that we have fewer reported HIV cases than those involving teens.

According to a recent article by Leslie A. Maxwell in the Sacramento Bee newspaper, both HIV and illegal immigration are gaining momentum at epidemic rates. A 2002 study found strikingly high HIV infection rates in migrants who travel between Tijuana and San Diego, with rates up to four times higher than in other California cities.

At Fresno’s University Medical Center, roughly 10 percent of the 550 current patients at the HIV clinic are Mexican migrants, Dr. Roger Mortimer, medical director of the clinic, told the Bee. “Typically, the patients we see have been infected for a while and come to us with some kind of opportunistic infection,” Mortimer said. “When we see them, we have to start by explaining what HIV is, because often they have never even heard of it.”

I would think that the government’s time would be better spent trying to regulate the borders in their efforts to reduce the cases of HIV in this country before trying to regulate an industry that has seen two cases in the past four years.

But if we are going to self-regulate our industry, let’s try going back to the days when sensuality and fantasy ruled, rather than toward vile and degrading acts that have little if anything to do with sexuality. That in itself would cut back the risks associated with HIV. If anyone out there doesn’t think they raise their risk of contracting HIV by getting three cocks in their ass and having them all cum in their blood-filled asshole, they are delusional.

If having piss in your eyes doesn’t cause hepatitis or some other health risk, then I am not sure how far you think you have to go in order to get an STD. People seem to be careless about their health and feel they are invincible until they actually get something — then they wonder why this happened to them. “Why me?” they cry.

But you do have a choice. No matter what anyone tells you, you have a choice to reject the offer when someone wants to pay to choke you, piss on you, and let a dozen guys from god-knows-where shoot cum up your bleeding asshole.

Sex is wonderful, sex feels great, but some of these films simply constitute abuse of women; they’re shot by woman-haters for woman-haters. Time and time again, I am asked by people outside the business what the heck has happened to porn, and I fall silent. Did the government slip something into your Starbucks? Do you need a vile and degrading porn movie to jack up your dwindling libido? Or are we so spoiled and bored that unless you can turn yourself inside out and wear your rectum like a raincoat, nothing — not even Viagra — will get your knob hard?

Stop worrying about who gets into government and start worrying about the kind of content you choose to shoot for your videos. Let’s face it, neither Bush nor Kerry is a big fan of piss-in-your-eye porn!

AVN Retraction

I’ve carelessly tossed around statements on this site that AVN had several lawsuits against it, and that some have been similar in content to Jennifer Rosenblatt’s. According to the information I now have, AVN has never been sued (except for a minor case ten years ago from someone who was receiving the magazine and didn’t want it).

Lynn LeMay told me in 1996 that she won a settlement from AVN regarding libel but when I check that claim out, I can find no substantiation.

Renee Johnson and Bryn Pryor (Mark Logan) had some screaming argument about six years ago. Though a harassment lawsuit may have been threatened by Renee, the matter was settled in-house. Bryn went to anger management classes and Renee got a car and a cushy job running AVN’s tradeshows.

Juliet Lowry was the head of the AVN internet division. She’s now out on her own. She’s been heard making similar complaints to Jenn’s about AVN but she remains friendly with Paul Fishbein.

I expect AVN will have to make a statement about Jennifer’s lawsuit. Jenn and AVN publisher Paul Fishbein were platonic friends for years.

I also posted last week that Paul Fishbein was on a rampage to destroy the career of Jenn’s husband Darren Blatt. According to another source, however, Paul does not even know what Darren does for a living, let alone has he tried to hurt Darren’s business.

I expect that AVN will defend itself from Jenn’s lawsuit by arguing that she was fired for just cause. That she wasn’t doing a good job. That people were complaining. That employees were threatening to quit. AVN will have to name names and provide specificity to these allegations to be persuasive. Who complained? Who threatened to quit? How was Jenn’s work incompetent?

They’re probably prepping her for public appearances now – a crash diet to get her down to 300 pounds, speech coaching, and a quick trip to Stepford for final programming preparation right before CES.

It gives me no pleasure to say this. Mike has always been fair to me even though we never had a lot in common, and we have been cordial since I was fired from AVN. Selective reading of his reviews from AVN could give Jennifer and her lawyers enough ammunition to shoot more holes in him than a screen door.

No Official Word From AVN:

On the lawsuit filed by Jennifer Rosenblatt, but then again I didn’t really expect anything. Generally these sort of things stay quiet and are quietly settled. Should AVN decide to actually fight it I would expect them to say something official. I’m sure the legal eagles are studying it hard for 500/hour or so.

One person I kinda do expect to hear from on this is Carly Milne over at pornblography.com she worked there during the timeframe in question. But then again as PR person for The likes of Seymore Butts and Suze Randall and Michael Ninn she has to get along with AVN so maybe she won’t have anything to say after all.

But what would she say if she were subpeonaed and deposed by either side? Hmmmm!

On Wednesday Tim and Felicia Fox (Fifi) arrived, as did Beater, Adrian and Jaime, mostly we just hung at the pool all day. On Thursday we all decided to hit the Dali Museum. Now that was an interesting trip. I always liked Dali even though he did overdo it at the end devaluing his work. Afterwards I took Kelly to the airport and Kissed her goodbye.

Thursday night the games began with he whole group going to a regular nightclub. Fishbein has been on a rampage to take away the clients of Jennifer Rosenblatt’s husband Darren, the promoter of the Players Ball. Darren does not have anything to do with Jennifer’s lawsuit.

This could get ugly.

A lot of female AVN employees have sued the company over the years for harassment, hostile work environment, etc, including Renee, who runs its trade shows.

10. Plaintiff worked for many years as Senior Vice President and Sales Manager for AVN and TCI [Teddy Communications Inc]. She performed her job competently at all relevant times. At the time she was fired, she was earning more than $300,000 annually in salary, commissions and bonuses.

12. In or about April 2002, plaintiff entered into a written employment agreement with AVN and TCI [through March 31, 2006]:

1. An initial base salary of $75,000 per year increasing to $82,500 per year March 1, 2003 and to $90, 750 on March 1, 2004, and to $99,000 on March 1, 2005;

3. Additional compensation in the form of a “bonus” of 20% of sales of classified advertising for the life of each contract…

4. A seven percent commission for sale of all new display advertising,

14. On or about April 15, 2003, plaintiff was diagnosed with acute anxiety and provided with a doctor’s note recommending that she take a 30 a day leave from work.

[LF says: I believe this anxiety was created by Jenn’s difficulty working for her (in her view) erratic and difficult bosses Paul and Darren. In Philadelphia in the 1980s, Paul had a secretary who went bonkers while working for him.]

15. Fishbein refused to allow her to take that leave.

16. May 18 defendants fired plaintiff for no cause.

17. Defendants have not paid plaintiff what is due her…

18. Within the year preceding her termination, and at times prior thereto, defendant ROBERTS repeatedly showed his dislike for women in positions of power in the workplace. ROBERTS spoke in a disparaging tone to female employees. ROBERTS also made inappropriate and offensive sexual remarks and gestures to women, including inappropriate and offensive remarks to plaintiff. Such conduct was unwelcome and plaintiff so informed ROBERTS. Nevertheless ROBERTS persisted in such conduct.

[LF says: I find that hard to believe considering that Darren showed his love for women by having a long-running affair with Fishbein’s gorgeous secretary Lisa Love while Darren’s wife, a former porn star, was pregnant and raising their kids.]

19. Within the last 24 months of the plaintiff’s employment, defendants including FISHBEIN fired numerous women and replaced them with men. Only a single female manager remains in defendant’s employ. Defendants were upset that plaintiff made so much money under the Employment Agreement — too much money for a woman.

The suit against TT Boy and OSHA fines are both pretty interesting. And as you say, they potentially could do to porn what Ashcroft cannot.

With Ashcroft, you’ve got freedom of expression issues. As you’ve pointed out many times in the past, no one really knows what is or isn’t obscene. The Rob Black prosecution? It’s a coin toss.

But OSHA, now that’s a whole ‘nother matter. If, for instance, my dentist has to wear goggles and latex gloves before working on my teeth; my nurse at the hospital has to have certain protective gear before changing bed pans, or drawing blood then you’re right; or my urologist has to wear a glove before doing a prostate exam: why wouldn’t the same apply to porn workers. Could be a boost to fetish tapes, but ….

Obviously haven’t seen the TT Boy lawsuit, but it seems like it too could present real dangers for the industry because the standard is so different.

Remember, while a defendant has to be found guilty beyond a reasonable doubt in a criminal trial, the standard for victory in a civil suit like the one filed against Boy is a preponderance of the evidence. That means, just enough to tip the scale one way or the other — 51% for or against gets a win for someone.

If my memory is right, Laura Roxx did double anal on that set. If they go after TT Boy on a negligence suit, the standard might very well be that Boy and his producers “knew or should have known” that this was a dangerous thing to do.

If I were Roxx’s attorney, I would put an expert up there who could say that even with testing, etc., there is no way to safely film a double-anal scene. Some people may enjoy doing it in their personal life; some people may want to watch it. But that doesn’t mean it’s safe to do.

My guess is that it won’t be too hard to find an expert who will say that the anus wasn’t designed for a double-A pounding; that all sorts of permanent damage could occur; and that even with enemas, lube, and whatever else you got going on, it’s still a messy, dangerous act that’s likely to end up like this.

Who they gonna put up on the other side? Skeeter Kerklove? “Dude! My wife loves having a baseball bat shoved up her butt. No harm, no foul.”)

If she wins, and I’m not suggesting she will win, then the next question down the road is: can you safely film an anal scene; can you safely film an oral scene; can you safely film intercourse; can you safely film a squirting scene? Because you know it’s not a matter of if but when.

I don’t know the answers to any of those questions, but they are entirely different from whether the depictions on film are protected by the First Amendment.

You bring up a really good point, one that I will get to in a moment. First of all OSHAs domain is the workplace, and they have the absolute right to go into any business and enforce workplace safety requirements. What this has to do with porn is pretty simple on the surface and complex when you look at it realistically. you see OSHA has very strict requirements for those who come into contact with bodily fluids as a part of their job. Just like in a pathology lab porners come into contact with bodily fluids all the time. Should OSHA choose to really enforce it’s rules on porners there would be no unprotected contact with sexual organs or with sperm. No facials, no unprotected sex, including oral on males or females.

OSHA could end porn in a way that Ashcroft can only have wet dreams about, because OSHA doesn’t operate around the first amendment, they have laws for workplace safety that are already on the books and enforceable, and OSHA has the power to fine offenders at will.

Now it’s interesting that you mention choking, because this really wouldn’t fall into OSHAs domain, per se, but it does fall into the domain of the LA County police who in conjunction with OSHA could deliver a coup de grace by criminally prosecuting the offenders or even worse open the door for civil remedies. I am surprised it hasnt already happened. Consider this scenario:

Pornchick goes to shoot for blue light piuctures and gets nearly choked out as a part of the scene, sure she agreed to it up front.

Now she either has or claims she has migranes that she never had before, also neck pain and maybe blurred vision.

She goes to an attorney who recommends a doctor, who in turn recommends a neurologist, she gets MRIs, therapy and whatnot.

A couple of years down the road the Lawyer files suit, and it’s a big one, not just all of her medical expense but she is entitled to “pain and suffering” or punitive damages because the lawyer contends that Blue Light Pictures was NEGLIGENT in not only allowing this activity but REQUIRING it as a condition of her employment.

Its an open and shut case because BLP can’t reasonably argue that they didn’t know that choking someone was dangerous.

It All Started On Monday:

I left Mexico Beach Monday on the breath of Hurricane Ivan. It looked, at the time to be bearing down on this area. As I drove through the little Florida towns like Carrabelle, which sounds quaint, and Sopchoppy, which sounds like a haven for axe murderers but I am sure it isn’t, I can’t help but think what it must be like to live in these places. This was the first time I had seen her in over a year, we talk a lot but schedules and such have kept us apart. Kelly is an ex porn chick who no longer wants any association with the business, she likes me though, maybe even loves me, I know I adore her. She is tall, thin, 20 years old and stunningly pretty but theres more to her, she is bright, energetic and really down to earth and sweet. On the way to the airport I can’t help but wonder if she will still see me with the same eyes that she did a year ago, or if she will instead wonder what she ever saw in me.

I’m playing with the fish in the saltwater fish tank (compliments of the Florida Aquarium) at baggage claim when she calls me on my cell phone. You may be wondering how you play with fish in a fish tank…well fact is pressing my finger to the tank got the attention of a bright silver and yellow fish who followed it whereever I moved it. I was delighting in making him go upside down and do loops and stuff…I’m easily amused. Kelly landed early so I wasn’t expecting her yet. She already had her bags and wanted to know where I was. I couldn’t help it,my throat got a lump in it, then she said Oh I see you.

She seemed happy to see me and honestly she makes my heart skip when I see her.

We came back to the hotel and then we went to dinner and had …what else…raw fish.

Tuesday Rolled Around:

We got up and went to the Florida Aquarium, I don’t think she really wanted to go but she knows me and knew it would please me. We both were disappointed, I figure it came out to about 25 cents per fish, nothing spectacular and not a very good aquarium. So we went and I had a tuna salad…that made me feel better.

We spent the rest of the day goofing off then we got ready for dinner. I took her to Berns Steak House. This is without question, the finest steak house in the world, I don’t give a rats ass what knife and fork magazine or whatever says. The dinner was simply the best, right down to desert. We got back in time to start watching COPS. Something about COPS makes you just want to watch it, probably because no matter how fucked up you and your life are, COPS pretty much gaurantees you will see someone who makes you look like…well normal.

Just as we settle into bed someone starts jackhammering, I kid you not, It’s 11:00 PM and they are jackhammering just below our room. Afte3r a couple of calls to the front desk the manager comes to my room and comps me the stay and moves us to a quieter room…seems they had to relocate a chiller and they had to do it when the restaraunt was closed. It was all good though cuz he took care of us.

I enjoy my quality time with Kelly. on Wed Tim Felicia and others arrive and the craziness is sure to start. Kelly isn’t into craziness, she is going home Thurs afternoon, just before the show officially starts.

SERENITY MAKES IT OFFICIAL

MULTI-AWARD WINNING ACTRESS ANNOUNCES RETIREMENT AFTER STELLAR ADULT FILM CAREER

LAS VEGAS — Multi-award winning actress and entrepreneur Serenity has announced her retirement from professional adult video.

Long recognized as one of the premier dancers in the industry, Serenity started her adult career in style by winning the $20,000 Topless Dancer World Championship in dominating fashion. She took that title on the road as feature dancer, wowing crowds, club owners and house dancers alike with her amazing choreographed performances.

Serenity comments, “That was an amazing weekend. I was a complete unknown and an underdog. When my name was announced as the winner, I was numb. Special thanks to Don Waite and the staff at Exotic Dancer as well as Universal Entertainment who was my sponsor. That win really launched my feature dancing career.”

In addition to feature dancing, Serenity also choreographed the opening number for the AVN show for many years as well as performed on stage at five of the major Las Vegas strip hotels.

Beginning her career as a girl/girl only performer, Serenity made the leap to boy/girl movies years later that culminated with signing a contract with Wicked Pictures. One of the first all condom contract performers, Serenity would work with Wicked for five years. With complete control over every aspect of her movies, Serenity put her stamp, as well as countless hours in pre and post production, into all her movies.

At Wicked, Serenity teamed with Jonathan Morgan and Martin Brimmer to form one of the most successful actress - director - writing teams in adult history. Crazed, Indigo Delta and Pornogothic were just a few of the cutting edge movies the trio made.

This effort paid off with Serenity’s first acting award from Nightmoves Magazine. The collaboration continued to pay off when the comedy Double Feature became, at the time, the most awarded film in AVN awards show history, netting Serenity her first Best Actress-Video award. This was followed up the very next year with M, Caught in the Act and another Best Actress-Video award for Serenity. Serenity is the only actress in AVN history to win back-to-back Best Actress awards. Along with critics, fans took notice as well and Serenity received multiple wins from popular yearly fan balloting from Rog Reviews, CAVR, ASM and Nightmoves, just to name a few.

Serenity comments, “Jonathan and I fought like brother and sister on just about every project. Mostly because we both really cared about the product we were making. Martin gave us some incredible scripts to work with and Steve Orenstein took a chance allowing us to make them.”

Serenity also found great success in mainstream media. E! Entertainment Channel took notice of Serenity in Cannes, France and asked her to appear on the “Wild on” series. Serenity appeared in more than 20 specials for E! garnering some of the highest ratings for the network.

Serenity adds, “It was one of the most exciting aspects of my adult career. Traveling the world, meeting new people, and getting paid for it — and by a Disney corporation of all things!”

In addition to television work, Serenity was publisher of Deja Vu Showgirls magazine for five years. As publisher she would assist with scouting talent for layouts, write articles and produce the monthly publisher’s column. Serenity also was the hostess for many of the Deja Vu Showgirl of the Year competitions.

Serenity says, “I had a really good time with the Deja Vu crew. It really went further than being an employee. We were all, and still are, like family. I really appreciate all that Harry, Troy and the entire Deja Vu organization have done to help with my career.”

Serenity has also been involved in numerous charity events including an International PETA (People for the Ethical Treatment of Animals) campaign for which she was honored in New York City.

Serenity comments, “As the owner of rescue animals, I was honored that PETA asked me to be involved. I look forward to working with them in the future.”

In 1999, Serenity launched Las Vegas Novelties and again broke new territory by becoming the first actress to open an adult novelty manufacturing plant. Signing some of the most well known adult actors and actresses, LVNI became quickly known and respected in the novelty side of adult. LVNI has grown tremendously since 1999 and continues to be highly respected throughout the industry.

As always the show was a blast and the installments are coming. There was no common thread this year to hold it all together and in all honesty it probably wasn’t as crazy as it was last year. that’s not to say that craziness didn’t happen….Oh it did…but it just wasn’t AS crazy….

Meantime there’s some new developments in porn….well one in particular I wanna chime in on.

Mixed Emotions:

It seems Cal-OSHA has fined TT boy and his companies a sum total of 60,000.00 for his negligence allowing Darren James to contract HIV. Essentially the gist is that TT wasnt in compliance with laws requiring protection for people who come into contact with bodily fluids.

On the one hand I don’t like the government interfering with private enterprise…period. It’s a bad precedent. On the other hand people should have a reasonable expectation of safety at their workplace.

On the one hand this is going to put the fear of government into companies in porn valley in a way that Ashcroft can’t. On the other hand, here in GA I can continue to shoot the way I always have with the same degree of essential immunity. I am not big enough for GA-OSHA to really care and besides nobody has ever gotten sick on one of my sets.(knock on wood). Is my product now going to be worth more?

Does it even matter to me? I put much more into my websites than into video lately…you all know why…It is because I make MUCH more money here on the net.

Now you can see why I have mixed emotions about all of this.

One thing I CAN assure you is that had anyone cared to listen this could have all been headed off at the pass….if we don’t control ourselves….you know the rest of the story.

I am here hanging out with Trixie, we went to the aquarium today or as Trixie calls it “The Fish Museum” I figure it came out to about 25 cents per fish….highly over rated but I felt better after I ate a tuna fish sandwich….Tonight Dinner at Bernes steak house..best steaks in the world period.
