I don’t know about any of those accusations, but I do know this…I’m 39 years old, and I’ve lived all over the country, and been to see the doctor as much as anyone. I have never, in my entire life, seen an employee at any medical facility who could match the rudeness, shitty attitude and sheer nastiness of Helen, the receptionist that works at the AIM clinic on Ventura in Sherman Oaks. Every single time I’ve been in that office, she’s been condescending, ugly, spiteful, and just plain rude to the performers who come in to get their tests, many of whom are brand new to the industry and understandably nervous about the testing process.

Helen has all the customer service skills of a wing nut, and whoever keeps her on the payroll needs to have their head examined.

Scotty, on the other hand, another AIM employee at the same clinic, is gold. A nice guy, who is always courteous and helpful, the polar opposite of that twat who sits at the front desk and ignores or insults the very people she’s being paid to help.

Crickett, who is a damn good writer, was fired from her job reviewing movies for AVN today. Why? Because of the comments she had made on simplyjimmyd.com wherein she explained the nominations process as she knew it. She didn’t impugn AVN or anyone there and she mentioned that she was rather careful about giving out pre-noms because she felt a pre nom really should have a shot at a nomination and should be an extraordinary video.

I can only surmise this was a little too much light somehow and now, over a week after the bit appeared, she is fired. Sounds like more chicken shit from the desk of Connelly to me, he hates it when AVN staffers write to other industry sites.

Truth is Crickett is far too a good a writer for AVN anyway, she is hip and highly intelligent, she writes more in the style of Maxim or FHM than in the mundane and often illiterate (reference Jenna being “to” [sic] racy for whatever HEADLINE a week or so ago) style of AVN.

When I spoke with Crickett she didn’t have anything bad to say about AVN and wouldn’t tell me who fired her just why she was fired and that she was caught totally by surprise on this one.

Too bad really, that’s a big loss for AVN and probably will be a big gain for someone else.

In many ways I feel like a protective parent with an unruly child. So I tend to take things a little personal when I see Rob attacked,justly or unjustly. He has a rather small circle of close friends who know, as I do, what a really good guy he is, deep down. I mean, I love the guy, and despite whatever people say about him, all he wants to do is make his mark in the biz and have a successful life and take care of those who he cares about.

Rob was about as eloquent as a homeless person on NIghtline tonight and though I’m glad that this case was tossed out by an “activist” federal judge my fear is that the DOJ is now more deterimined than ever to take this industry down. He suggested that the Bush administration target ALL producers of pornography.

This Is Your Monday Morning Wake The Fuck Up Call:

The one site that should have the most information for the industry on this whole Extreme Associates thing is AVN and guess what, they have the least. I thought Kernes was the legal Beagle over there, didn’t anyone boher to dial his fucking extension and say hey what the fuck does this mean?

Let me point out

Rob Black, scumbag of the year and no friend to porn has NOT made history.

The industry has not dodged any bullets.

This case can go a lot of ways from here, some are highly unlikely others are almost a sure thing.

The first is the decision to appeal, lets look at that.

Should the DOJ choose NOT to appeal this decision then there is effectively no law against obscenity in the third US District, porners should understand this, its why it is legal to shoot in L.A. but I digress. If the DOJ chooses not to appeal then Rob walks, plain and simple.

Should the DOJ choose to appeal this ruling by judge Lawrence (they have 30 days to file) then the third district court of appeals will hear the appeal and 3 judges will decide if Lawrence was right or wrong in his ruling.

If the decide he was right, then the DOJ can appeal that ruling to the Supreme court.

If they decide he [ Lawrence] was wrong, then Rob stands trial as planned. and if he loses Rob may appeal again to the third district court of appeals then to the supreme court.

Should this case make it to the Supreme Court then both Mary Beth Buchanon and Lou Sirkin (Robs attorney) will argue in a very limited amount of time as to what they think the Supreme Court should rule regarding the constitutionality of the case.

If the Supreme Court does decide to hear this case, no matter what stage it comes in, it is likely that they will attempt to define obscenity, in constitutional regards, once and for all, which could be very bad for porn, or very good.

Once the supreme court defines obscenity then the game is over and thats that, obscenity is NOT protected free speech.

So in short, the decision by the DOJ is do we let the decision stand and essentially have no law against obscenity in the third district or do we appeal it and risk losing on a broader scope? It doesn’t take a rocket scientist to see where this is likely to go.

What the industry needs to remember is that Black is no friend, he has brought this upon us all. Just because he is the enemy of the justice department and the justice department is thought to be our enemy that doesn’t make Rob our friend, Rob could, theoretically, single handedly bring the entire industry to soft core only, and that is not a stretch when you look at the make up of the Supreme Court in three years, it will almost certainly be very conservative with two or more new Bush appointees.

So my colleagues in Porn Valley, you have now been given a very brief education on the judicial system, AVN, since you obviously don’t know it feel free to “borrow from me” but at least have the decency to credit me when you do…..

I read the AP report on the Pittsburgh Post-Gazette site.

The feds didn’t have much to say, other than that they were still reading the 45-page opinion. It’s not available online.

I looked up Judge Lancaster, and he does seem to get reversed.

In this case, Sirkin apparently used Scalia’s language from one of the gay rulings — I think it was the ruling last year striking down anti-sodomy laws in Texas.

Scalia was outraged by the lead opinion, and in essence said: “Hey, if this is legal, so is bigamy, group marriage, incest, and sex with animals.”

What Sirkin apparently did is pretty smart: He took Scalia at his word and told Judge Lancaster: Don’t believe me. I’m just agreein’ with the big guy in D.C. It’s all legal.

According to the AP, Judge Lancaster bought it and really did write that obscenity laws are unconstitutional.

I can’t believe the Feds won’t appeal this. For one, it does not strike me as correct that all obscenity laws are unconstitutional — just because two consenting guys or gals can do what they want in the privacy of their home to each other shouldn’t necessarily mean that there aren’t limits to what people can do to one another in a commercial venture.

For another, the Supremes have always held that some things are just plain obscene. I find it hard to believe that there’s a majority of judges who are going to say anything and everything goes.

Finally, the Bushies have to appeal to show their base that they meant business. What the lawyers I work for have always told me is that appeals are cheap. To just pack up and go home without appealing seems like they’re sending the message that they just don’t care now that the election is over. Geez, they’ve whacked the snot out of CBS over Janet Jackson’s breast. They’re gonna give Rob Black a free ride?

But you never know. Bush made a big stink over the gay marriage amendment prior to the election. Then afterwards said, well, hey, there’s really not much support for it. Then had to back track and say: oh, baby I’m all for it; we just need someone to lead the way and I’m there.

What’s Next For Extreme?:

I was researching and writing this when Bob sent me the perfect examination, this is it:

Now, this is interesting. But don’t think it’s the end of the story. It just lays the groundwork for the next round, and may hasten the inevitable.

What’s the inevitable? The U.S. Supreme Court taking a second look at Miller, the ruling that basically said, we don’t know how to define obscenity, but if it offends the sensibilities of your community, it probably is. Miller is the reason you can’t buy a Playboy in a 7/11 in Cincinnatti, but you can watch a woman take a leak on video in Times Square.

So, without having read the opinion, and with only Mike’s three or four sentence description to go on ( meaning, I may be full of crap), here’s what’s likely to happen next.

The Justice Department could try to strike a plea bargain with Rob, but that’s not likely. I don’t believe Sirkin would do it unless it involves the Feds paying Black money and saying their sorry while watching every volume of Cocktales.

What’s more likely, is that Justice will appeal to one of the federal courts of appeals in Pennsylvania. They’ll either tell the judge in question that he’s wrong, that community standards are for a jury to decide, and send it back for trial.

Or, they’ll agree with the judge, in which case the Feds will appeal again to the Supreme Court. And, the Supremes will hear it, since they’ve taken on other porn cases lately related to child porn and the Internet, and because Miller is such a mess.

The hasten part. If this had gone to trial, it would have been a good three to five years before the Supreme Court heard the case. Now, depending on how a federal appeals court rules, they could hear it next fall.

Win or lose, this case was headed for the Supreme Court all along. Governments, community members, and the pornography industry have a right to know what’s inbounds and what’s out of bounds.

Rob Black is the perfect case for both sides because he was so obviously out of bounds. Win or lose, one side was going to appeal this thing.

For both sides, the watchphrase might be: “be careful what you ask for, you just might get it.”

Judge Lancaster considers being a judge “the best of all worlds,” a place where he can combine “the intellectual aspect of law as a philosophy, the drama in the courtroom, and the interaction with real people with real stories.”

They also kept wardrobe my wardrobe person had lent them for the show, and ripped off several small producers Jade had contacted on her own. The psycho husband (suitcase pimp psychoticus) is the diminutive “mastermind,” Jade just does what he says.

JADE LIEU, one of the two thieves, is on the far left. She is Northern Chinese, with extremely heavy Chinese-British accent, 32 years old, and I think around 5′3″. Her husband, Steven Leeds, is an inch or two shorter, with dark hair and dark eyes, clean-shaven, average build, and complains about the U.S. and the porn industry all the time. When they shoot for you Jade will try to “forget” to sign the release, having been coached by her husband.
